Testimonial Disclosure

What we will and will not publish about other people's results. Today the answer is nothing, and this page explains the rule that keeps it that way until we can back a claim up.

There are no testimonials on this site

Current status

Trade142 publishes no student testimonials, no case studies, no student results, no profit-and-loss screenshots, no account statements, and no success stories. Not on this site, not in our emails, and not in our advertising. If you have not seen any, that is not because we are between campaigns. It is deliberate.

Section 02

Why not

When a business shows you someone who succeeded, it is telling you something about what you can expect. United States advertising rules treat it that way too: an endorsement that depicts a central attribute of a product communicates that the endorser's experience is representative of what customers generally get. If the business cannot substantiate that, it has to disclose what customers generally achieve — and substantiate that number as well.

Trade142 does not have that data. We have not been running long enough, at enough scale, with enough tracking, to make an honest statement about what students generally achieve. Until we can, any testimonial we published would be implying something we cannot support.

A "results not typical" line underneath does not fix it. The Federal Trade Commission has published its own copy-testing finding that such disclaimers do not adequately reduce what the advertisement communicates. So we do not use one, because using one would be pretending to solve the problem.

The shorter version

There is a well-documented pattern of trading educators pointing at other people's wins as evidence that the training works. We are not going to do the softer version of that. When we have real data, we will publish the real number, including the parts of it that are not flattering.

Section 03

The standing rule

Editorial rule — binding on everyone who writes for Trade142

No testimonial, case study, student result, screenshot, profit-and-loss image, account statement, or student quote referencing outcomes may be published on any Trade142 property until, and only until, all three of the following are true:

One. An outcome-tracking system exists and has produced enough data to describe what students generally achieve.

Two. Counsel has reviewed and approved the resulting generally-expected-performance statement and the evidence file behind it.

Three. The disclosures in the next section render immediately next to the testimonial itself — not in a footer, not on a separate page, not behind a link.

This rule is enforced in the content system, not left to whoever is writing that week to remember.

Section 04

What would have to appear alongside one

If and when a testimonial is ever published, each of the following would appear next to it, prominently, and would not be collapsible or hidden behind a link:

  • That the testimonial may not be representative of the experience of other clients.
  • That the testimonial is no guarantee of future performance or success.
  • Where more than a nominal sum was paid for it, that it is a paid testimonial.
  • A substantiated statement of what students generally achieve, with the evidence retained and producible on request.
  • Any material connection between the person and Trade142 — see the next section.

The wording that would run with one

"This statement is one customer's experience. It is not typical, it is not a promise of any result, and it should not be read as one. Most people who trade retail futures accounts lose money. Trading futures involves substantial risk of loss and is not suitable for everyone."

Where the person received anything at all — a discount, free access, a payment, a referral arrangement, or a personal relationship with anyone here — that fact runs in the same block, in the same size type, not in a footnote.

If the statement contains or implies any figure — dollars, points, percentage return, win rate, account size — it also carries the hypothetical-performance statement reproduced in the Risk Disclosure, and we keep the underlying evidence for it. A number we cannot evidence does not get published, with or without a disclaimer.

Section 05

Material connections

A material connection is anything that would reasonably affect how much weight you give to what someone says about us. If it exists, it gets disclosed in the testimonial itself, in plain language, not buried in a legal page.

  • Free or discounted access of any kind.
  • Payment, a commission, or an affiliate arrangement.
  • Employment, contracting, or any business relationship with Trade142 or James Norman.
  • A prize, an entry into a draw, or any other incentive offered in exchange for the feedback.
  • A current or former mentorship relationship, including alumni.

Section 06

Screenshots, P&L images, and account statements

These are treated as results claims, not as illustrations, and the standing rule applies to them exactly as it applies to a written quote. A screenshot of a winning trade is a performance claim with a picture attached.

Charts used to teach are a different thing and are allowed: a marked-up historical chart shows how the framework's rules label price action that already happened. Where any simulated or hypothetical result is shown, the disclosure described in the Risk Disclosure appears immediately next to it.

Section 07

Social media, video, and email

The rule is not a website rule. It applies to every surface Trade142 controls or pays for — video, short-form clips, email, paid advertising, and anything an affiliate publishes on our behalf.

A spoken claim in a video carries the same weight as a written one, and a disclosure that only exists in a page footer does not travel with a clip. Where a video shows results, the disclosure has to be on screen, legible, and visible long enough to read.

Section 08

If you see one anyway

If you find a student result, a testimonial, or a performance claim on any Trade142 property, in any advertisement, or in anything an affiliate has published about us, tell us at support@trade142.com. We will take it down while we check it against this page.

That includes claims made about us by people we did not ask. We would rather remove a flattering quote than keep one we cannot stand behind.
